Neutral Umpires and Honest Black Robes:
What Is, and Is Not, Said at Supreme Court Confirmation Hearings

Featuring Professor Carolyn Shapiro,
Former Illinois Solicitor General

Former Illinois Solicitor General Carolyn Shapiro, a professor at Chicago-Kent College of Law and the founder and co-director of its Institute on the Supreme Court of the United States, will discuss how Senators and nominees to the Court alike have generally described the role of the Court and its justices during confirmation hearings.  These descriptions often emphasize objectivity and neutrality, sometimes even suggesting little-to-no role for discretion, judgment, or judicial philosophy.  These discussions paint an inaccurate picture of what the Court actually does and can create unrealistic expectations among members of the public.
